Palestine Requests Court Action Over Gaza War

Riyad MansourThe Palestinian government has confirmed that it will launch court action against Israel at the UN-backed International Criminal Court, ICC.

Speaking at United Nations headquarters on Friday, the Ambassador of Palestine said retroactive action had been requested for alleged crimes committed by Israel in Gaza from June to August last year.

The 50-day conflict between Israel and the Palestinian faction, Hamas led to the deaths of 2000 Palestinians and 70 Israelis as well as the widespread destruction of property.

Riyad Mansour, Permanent Observer of Palestine to the United Nations in New York said the request was made to the ICC in The Hague on Thursday.

“We delivered last night a letter to the Office of the Registrar in The Hague requesting retroactivity with regard to the crimes committed during the last war in Gaza and reserving our right for other retroactive crimes committed by Israel.”

Mansour, told reporters in New York after he transmitted copies of the documents to the UN Secretariat, “It is a peaceful option. It is a civilized option. It is an option that anyone who upholds the law should not be afraid of. It is an option we are seeking in order to seek justice for all the victims that have been killed by Israel, the occupying Power.’

PA said it will seek action against Israel at the ICC, which is based in The Hague, for war crimes committed by Israel in the latest 51-day war on Gaza during the summer, in which nearly 2,200 Palestinians and 70 Israelis died.

The ICC membership bid follows the UN Security Council’s rejection of a Palestinian draft resolution calling for a three-year deadline for ending Israel’s occupation of Palestinian land.

International law views the West Bank and East Jerusalem as occupied territories and deems the building of Jewish settlements on the land to be illegal.

Israeli Prime Minister Benjamin Netanyahu Thursday said that he expects ICC to reject the application filed by PA for membership.

He claims that the PA is an entity that is in alliance with Hamas, which he described as ‘a terrorist organization.’

According to Israeli media sources, the membership would enable Palestinian to file lawsuits against Israel and lift a decades-long impunity that Israel has been enjoying.

The Palestinians formally submitted an application to join the International Criminal Court to the UN Secretary-General on Friday.

It will take 60 days to complete the accession process to the court.

There was no immediate reaction from Israel at the UN.
